Viggle Calls It Open-Weight. Its Own License Locks Out the US.

Viggle's new model claims to be open-weight. The license it ships under bars the US, EU, UK and South Korea from using it — the first installment of RCTV's open-weights claims tracker.

Viggle’s own announcement, posted September 4, calls its new release “our first open-weight model.” The model card two clicks away tells a narrower story: the weights are a licensed derivative of MiniMax’s H3, and the license attached to them grants no rights in the United States, the European Union, the United Kingdom, or South Korea. The spectrum

Line these up and a pattern falls out. At one end: MAGI-2 Preview, NVIDIA Cosmos 3, and Helios ship exactly what they say — weights, unmodified permissive licenses, nothing held back. One step in: MiniMax H3 and HY-World 2.0 are open with real restrictions, but the restrictions are in the license text a reader can find. One more step in: Viggle-Animate is open with a restriction the vendor’s own announcement doesn’t carry. And at the far end, HappyHorse-1.0 and SkyReels V4 aren’t open at all; the label exists (a marketing page, launch coverage) and the artifact doesn’t — with Wan 2.7 beside them for a different reason. Nobody at Alibaba ever called it open. The version number did the work anyway.

Why this keeps happening

Two mechanisms are doing the work here, and they’re different problems. The first is derivative-license inheritance: once a lab publishes weights under a restrictive community license, anyone who fine-tunes those weights inherits the restriction whether they disclose it or not. MiniMax’s H3 has been built into at least seven outside releases since August — H3-World, the fal-hosted H3 Max variants, Viggle-Animate, and, on the day this page first published, Video Rebirth’s HyperFlow. Viggle was the first of them to carry the license’s fine print without saying so in its own announcement; HyperFlow is the second, though its model card, unlike Viggle’s announcement, puts the exclusion up front. As more labs build on each other’s open weights, this is the failure mode to expect more of, not less.

The second is simpler and has nothing to do with licenses: a label with no artifact behind it. SkyReels V4 has been described as open-source since its February preview, here included, and Skywork’s GitHub has never carried a V4 repo. Wan 2.7 is the same shape from the other direction — a closed release wearing an open line’s version number, which is how it spent five months labelled open on RCTV’s own reference page before the September 13 fix. Neither is a licensing question. Both are the same simple check — does the repo exist — and it is the check that gets skipped.

What to watch

The next entrant worth checking is whichever lab fine-tunes H3 or LTX-2.5 next; the license-inheritance pattern will keep repeating as long as the open-weights layer keeps growing on itself. NVIDIA’s Cosmos line carries a different kind of risk: NVIDIA’s pending acquisition of Hugging Face, still with no confirmed closing date anywhere primary, sits under every open-weight model this page tracks that hosts there. And this page itself is the test — the next update either finds a vendor correcting its own claim, or it doesn’t, and that absence will be as much the story as a correction would be.
